因为我国刑法实行罪责自负、对立株连的准则，因而，从法令的角度来说，父或母违法的，子女是不必承当法令责任的。

依据我国《公务员法》第二十六条规则，下列人员不得选用为公务员：

（一）因违法受过刑事处分的；

（二）被开除中国党籍的；

（三）被开除公职的；

（四）被依法列为失信联合惩戒目标的；

（五）有法令规则不得选用为公务员的其他景象的。
